Ld. Lawyer for the C.S.E.C. Ltd. is present. Complainant is absent on repeated calls. No evidence is adduced. So, only relying upon the complaint and written version we are disposing the matter considering the fact that the complainant has been enjoying electricity from the existing meter as one of the shop owner of Corporation Market situated at 25/A, Sir Gurudas Road, Kolkata-700 011 and that was detected at the time of inspection by the O.P. as per prayer by the complainant. Fact remains, complainant was already reported by the C.E.S.C. Ltd. vide letter dated 30/07/2013 that as per Clause-15 of the Regulation No.-22 of the W.B.E. Regulatory Commission. The O.P. is unable to accede  the complainant’s request for  separate meter and against that the complainant appeared before this Forum for relief.

Fact remains, there is some legal obligation of the O.P. in respect of giving new connection on the ground that the complainant has been running a business in a commercial complex and the main meter was installed for the commercial complex wherefrom all the shop keepers are getting electricity and consuming electricity and if any shop keeper wants to know his separate consumption he may place one sub-meter with permission of the C.E.S.C. but complainant did not adopt that procedure but prayed for fresh line what cannot be entertained by the O.P. as per terms of Clause-15  of the Regulation-22 of WBERC. So, in this case, no doubt no negligence or deficient service on the part of the O.P. is found at all.

In the above circumstances, we are directing the complainant to take such step for installation of sub-meter with previous consent of the O.P. and accordingly, O.P. is also directed to take such step so that complainant may fix a sub-meter to determine his monthly consumption from the main commercial meter of the present commercial complex at 25/A, Sir Gurudas Road, Kolkata-700 011

Accordingly, this com. Is disposed f finally without giving any further relief in favour of the complainant.

Thus this comp. is finally disposed of.
