Ld. lawyears for o.p. referring decision of the Hon’ble Supreme Court of India passed in Civil Appeal no 5466 of 2012 arising out of SLP(c) no. 35906 of 2011 gas submitted that the instant case is not maintainable in view of the facts and circumstance disclosed on record  and more particularly this is a case of commission of theft of electricity energy.

In view of the above the instant case stands dismissed.

Complt. is at liberty to agitate the issue before the appropriate forum on the self same cause of action.
