The case of the complainant in short is that complainant is a tenant of the premises mentioned in the cause title of this petition and living without electricity with her family members peacefully with the landlord. Complainant has no meter, as such, complainant made an application for meter for domestic purpose for new connection in her name upon payment of necessary fees a sum of Rs.200/- and also give necessary permission from the landlord although, no permission is required from the landlord.
The CESC Ltd issued application form for new connection i.e. annex-A, it is pertinent to mention that without payment of necessary fees i.e. Rs.200/- the CESC Ltd. never accepted the said form i.e. annex-A. So it is admitted fact that complainant paid necessary fees at the time submission the said form and the CESC Ltd. never mentioned in their w/v that the complainant did not pay requisite fees of Rs.200/-.
But the CESC Ltd. refused to give new connection / meter to the complainant on allegation of ‘Getting supply from another meter’. Hence the case was filed by the complainant with the prayer contained in the petition of complaint.
O.ps. had entered their appearance in this case by filing w/v and denied all the material allegations labeled against them and prayed for dismissal of the case. Ld. lawyer of o.ps. in the course of argument submitted that the case has got no merit and the same is liable to be dismissed.
Decision with reasons:
We have gone through the pleadings of the parties, evidence and documents in particular and we find complainant is very much entitled to new electric meter after observing all the formalities as per existing rules of electricity and complainant is entitled to relief.
Hence, ordered,
That the case is allowed on contest with cost against the o.ps. O.ps. are jointly and/or severally directed to install new electric meter in the premises no.49/5/H/170, Karl Marx Sarani, Kolkara-23 after observing all the statutory formalities of the Electricity Act within 45 days from the date of communication of this order. There shall be no order as to cost.
