            In a nutshell, the case of the complainant is that complainant made an application for domestic purpose new connection to the CESC Ltd. on 19.3.12 upon payment of necessary fees of Rs.200/- and the CESC Ltd. verified all the necessary documents issued form for new connection to the complainant on the aforesaid dated.

            The CESC Ltd. issued a letter to complainant on the same date i.e. 19.3.12 and inform that an inspection will be held on 24.3.12 and they did the same. The CESC Ltd. further on 26.3.12 issued a letter to complainant and stated that due to getting supply from another temporary connection they refused to give new connection to complainant.

            The CESC Ltd. further on the same date written in the aforesaid bill that ‘SPLIT – 26.03.2012’ they refused to give supply meter to the complainant. due to dissatisfied of the aforesaid letter dt.26.3.12, the complainant wrote a letter to the CESC Ltd. and briefly discussed about the urgency of the matter.  The complainant is ready to pay necessary service charges to the CESC Ltd. Hence the case was filed by complainant with the prayer contained in the petition of complaint.

            Both o.ps. had entered their appearance in this case by filing w/v and denied all the material allegations labeled against them and prayed for dismissal of the case stating that complainant h as got no cause of action  to file the instant case.

Decision with reasons:

            We have gone through the pleadings of the parties, evidence and documents in particular and we find that complainant made application for a new connection to o.ps. for domestic purpose on 19.3.12 after payment of necessary fees of Rs.200/- and o.ps. issued a letter to complainant on 19.3.12 and further informed that inspection will be held on 24.3.12 and o.ps. vide their letter dt.26.3.12 informed complainant that due to getting supply from another temporary connection o.ps. refused to give connection to complainant.

            From the record we find that no reason for refusal of new connection in the house of complainant and this action on  the part of o.ps. amounts to deficiency in service being service provider to its consumer / complainant and complainant is entitled to relief.

            Hence, ordered,

            That the case is allowed on contest with cost against the o.ps. in part. O.ps. are jointly and/or severally directed to give new connection to the complainant for domestic purpose and are further directed to pay compensation of Rs.2000/- (Rupees two thousand) only for harassment and mental agony and litigation cost of Rs.1000/- (Rupees one thousand) only within 45 days from the date of communication of this order, i.d. an interest @ 9% shall accrue over the entire sum due to the credit of the complainant till full realization.

            Complainant is at liberty to file execution case before this Forum in case of non execution of the aforesaid order in its entirety within the stipulated period under the provision of the COPRA, 1986.

            Supply certified copy of this order to the parties free of cost.
