The petition of complaint has been filed by the complainant Aparna Maity against the o.ps. M/s CESC Ltd. The case of the complainant in short is that complainant applied for a domestic meter on 11.6.12 on payment of necessary charges of Rs.200/- and o.ps. issued letter to the complainant on 11.6.12 and informed an inspection will be held on 19.6.12 and inspection was held accordingly on the said date. But no action was taken by o.ps. and thereafter complainant wrote further letter to o.ps. on 22.6.12, but without any fruitful result. Hence the case.
O.ps. had entered their appearance in this case by filing w/v and denied all the material allegations labeled against them and stated in their w/v that the existing service connection was overloaded and o.ps. required common passage where all the meters meter board can be installed and despite the same complainant failed to do so and prayed for dismissal of the case.
Decision with reasons:
We have gone through the pleadings of the parties, evidence and documents in particular. Ld. lawyer of complainant submitted in the course of argument that complainant shall arrange for suitable accommodation for installation of new meter within the portion complainant occupies instead of common meter board and at it ld. lawyer of o.ps. submitted that such installation can be done, if the complainant observes all the formalities and only after joint inspection by the parties taking into consideration the safety security aspect in this regard as provided in the regulation of CESC.
We find that electricity is beneficial service and one should not be denied of having the benefit of electricity if all the pre-conditions of such installation of new meter are found proper. In w/v o.p. admitted that they are agreeable to new service connection.
In view of the above findings and taking into consideration the entire materials on record and evidence in particular we find that the prayer for installation of new meter sought for by complainant deserves consideration.
Hence, ordered,
That the petition of complaint is allowed on contest in part without cost against the o.ps. Complainant shall provide space for installation of new meter and/or new service connection within the occupancy of her area and apply accordingly before the o.ps. at her own cost and after joint inspection by the parties o.ps. shall install new meter and/or new service connection within 30 days, if the safety security points are found satisfactory. Thus, the instant case stands disposed of. Parties to this case are directed to comply with the aforesaid order within 30 days from the date of communication of this order.
Supply certified copy of this order to the parties free of cost.
