ORDER

The case was taken up through video conferencing on 30/09/2020.

The counsel for complainant Sh. Kuldeep Rana, addressed arguments in detail.

It is stated by the complainant that after booking of the property, BPTP/OP neither handed over the possession nor refunded the money. However, the complainant surrendered the provisional booking/registration of plot no. J-303/C. CADE121773 on 15/04/2014 and also executed affidavit cum undertaking therewith. Copy of the surrender, affidavit and undertaking wherein the is clause of settlement is mentioned. Thereafter, he sent legal notice to handover the possession. Prayer to hand over the possession has been made in the complaint filed before this commission beside compensation for harassment, mental torture and litigation cost.

The Commission has considered the arguments and the material placed before us. As per the documents filed by the complainant, the matter had been settled with the OP and the complainant signed the documents and filed  affidavit/undertaking.

In view of the above facts, it is clear that the  complainant’s prayer for handing over the possession deficiency in service on the part of OP. After surrender of the plot/provisional allotment and settlement, the issued raised do not survive in our considered view. Accordingly, the complaint is dismissed with liberty to approach the Civil Court to resolve the complex dispute necessitating evaluation of witnesses and evidence as the same cannot be adjudicated in summary proceedings by this Commission.
