Present:    Counsel for Complainant, with Complainant in person.

                None for OP.

               

The short case of deficiency alleged is that OP travel agency charged Rs.15,000/- for facilitating visa for travel to London. The visa could not be given for not supplying necessary financial documents of her son-in law. The OP’s travel agent never asked the complainants to submit the said documents engendering rejection of visa in first place.. The documents were again supplied and visa was granted. But, in this process complainant has to spend extra for cancellation of earlier booked tickets and rescheduling of Journey, besides additional fee for visa.

The OP was issued notice by Complainant and by this Forum, but without response. On carefully hearing of matter, we find it a case of patent deficiency and harassment as part of OP. We have seen Annexure A-6, A-4, A-7 & A-8. (Collectively) showing expenses of Rs.54,816/-.

In the light of this, we direct OP to pay Rs.54,816/- with interest of 9% from date of lost deposit till payment, and we award Rs.40,000/- as compensation for litigation and harassment expenses.

The order shall be complied with within 30 days of the receipt of the copy of the order; otherwise action can be taken against OP under Section 25 / 27 of the Consumer Protection Act.

File be consigned to record room.

Copy of the order be sent to the parties free of cost.
