The Ld. Counsel for th OP No.1 is present by filing Hazira. None is present on behalf o the complainant. Today is fixed for showing cause by the complainant  as to why the complaint shall not be dismissed for default.

The record speaks that on 24.12.2019 the complainant was directed to show cause on 24.01.2020. On 24.12.2019 it was fixed for appearance of the parties. In spite of specific order the complainant remains absent today without taking any steps. Over telephone contact was made with the Ld. Advocate for the complainant. Information was given to the Ld. Advocate for the complainant to the effect that due to his absence / non taking of any step / non filing of reply to the show cause the complaint will be dismissed. Over telephone it is intimated by the Ld. Counsel for the complainant that the forum is at liberty to dismiss the complaint.

As the reply to the show cause is not forthcoming from the end of the complainant, we have no other option but to dismiss the complaint for default.

Hence it is ordered that the complaint being no.RBT/CC/145/2019 is hereby dismissed for default. There is no order as to cost.

Let plain copy of this order be given to the party/ies free of cost as per CPR, 2005.
