Heard proxy Counsel Shri Karan Dewan who submits that he has been authorized by Counsel for the Petitioner to argue the matter on admission. The complaint filed by present Petitioner was dismised by the District Forum. Against the District Forum’s order, the present Petitioner filed appeal before the State Commission. The State Commission has directed the Insurance Company to process the claim of the Complainant in accordance with law but observed that nominee of the heir is entitled to amount of insurance with 6% interest from the date of the order of the State Commission. The grievance of the Counsel for the Petitioner is that the interest awarded is too low as also the interest should have been awarded from the date of filing of the complaint. The order regarding payment of interest and also from which date it should be paid being discretionary matters need not be interfered unless the same is shockingly unjust which is not the case taking into account the facts and circumstances of the case. The Insurance Company shall accordingly comply with the order of the State Commission within a period of 45 days from the date of receipt of the order. The revision stands disposed of accordingly in aforesaid terms with no order as to costs.
