          The case of the complainant in short is that complainant’s daughter Debarati Roychoudhury purchased a Bajaj Allianz New Family Gain policy from the o.p. effective from 9.3.10. The annual premium was Rs.6000/- and the policy term was “10 years” for sum assured Rs.60,000/-. Maturity Benefit was the fund value at the end of 10th year, (since the policy was for 10 years), was Rs.76,960/-. The death benefit was earmarked as Rs.60,000/- plus Fund Value. The fund value at the end of the year stood on Rs.62,363/-. Nominee name is written as Deepshikha Roychoudhury. The policy holder died a premature death on 6.12.10 at the age of about 31 years.

            After the application (application no.1202150694) for the policy and the payment of the cheque on 17.12.09 the o.p. company conducted medical check up including blood test etc. in Jan. 2010. O.p. company, thus conducted intensive and thorough check up with their own medical officer and then issued the policy vide no.0144089437 on 9.3.10, after the expiry of a couple of months of the application for the policy and the payment for the same.

            The inordinate delay in issuing the policy especially in view of the full payment much earlier, (cheque encashed on 1.1.10), was explained and assuaged by the o.p. authority. O.p. company issued a letter dt.2.2.11, rejecting the claim.  Hence, the case was filed by the complainant with the prayers contained in the petition of complaint.

            O.ps. had entered their appearance in this case by filing w/v and denied all the material allegations labeled against them and prayed for dismissal of the case. Ld. lawyer of o.ps. in the course of argument submitted that the case has got no merit and the same is liable to be dismissed.

Decision with reasons:

            We have gone through the pleadings of the parties, evidence and documents in particular and we find that o.ps. had sufficient deficiency in service being service providers to their consumer / complainant and complainant is entitled to relief.  

            Hence, ordered,

            That the case is allowed on contest with cost against the o.ps. O.ps. are jointly and/or severally directed to refund the claim amount of Rs.1,22,363/- (Rupees one lakh twenty two thousand three hundred sixty three) only to the complainant and are further directed to pay to the complainant a sum of Rs.25,000/- (Rupees twenty five thousand) only as compensation for harassment and mental agony and litigation cost of Rs.5000/- (Rupees five thousand) only within 45 days from the date of communication of this order, i.d. an interest @ 10% p.a. shall accrue over the entire sum due to the credit of the complainant till full realization.

            Supply certified copy of this order to the parties free of cost.
