The short complaint is that though complainant had paid consumer loan no.401191955 and 401191956, taken from OP Bank in 2009, and bank had issued another loan in May 2009, after issuing a NOC in respect of other loan, yet the CIBIL, records displayed the loan as “Written off”, due to which his application for another credit card was blocked. The OP bank showed Rs.3,300/- outstanding, which was also cleared in 2010, by paying Rs.1,650/- two times. Yet, it is stated that CIBIL records are not corrected. He filed this complaint and write to RBI, and due to its intervention on 16.07.12, after filing of case, he learnt from RBI that “Written Off” status has been removed.
The Complainant is for all the harassment faced and litigation forced on him.
We have considered the entire matter and from that it is a self-speaking case of deficiency on the part of OP Bank in not taking up the cause of complainant in right erne of to resolve it at the hilt. We therefore, hold OP guilty of imperfect services and awarded a compensation of Rs.30,000/- inclusive of harassment, deficiency and Rs.20,000/- for litigation expenses.
The order shall be complied within 30 days of the receipt of the copy of the order; otherwise action can be taken against OP under Section 25/27 of the Consumer Protection Act.
File be consigned to record room.
Copy of the order be sent to the parties free of cost.
