Ld. Advocate for the complainant/petitioner submits that the sole complainant Haridas Chakraborty died leaving behind his daughter as sole heir. So her name may be substituted in place of deceased complainant.

It appears from the photo copy of death certificate that Haridas Chakraborty died on 14/01/2023 and application for substitution filed on 16/10/2023 is within the statutory period.

Therefore, application filed by the petitioner Kaushiki Chakaraborty is allowed.

So, the name of Kaushiki Chakraborty be incorporated as complainant in CC/211/2020 in place of deceased Haridas Chakraborty.

Therefore, the Misc. Application is allowed and disposed of.
