The Complainant had saving account with OP bank bearing no.20010100435932. The complainant had swiped his debit card with ATM of OP2 at Bahdurgarh to withdraw Rs.10,000/- but he neither received the payments nor received any slip of transaction this account was debited which came to his notice when next transaction for Rs.10,000/- was done successfully through HDFC bank as per statement of account in which balance was shown Rs.1,446/- instead of Rs.11,446/- i.e. shortfall of Rs.10,000/-. The complainant immediately approached Dy. Manager, Axis Bank in Bhadaurgarh and explained all facts of the incident occurred with him. Later on complainant also approached OP2 to register his complaint well but OP2 refused the same. Thereafter complainant approached Axis Bank, Khan Market, New Delhi and reported the matter to the Manager as per Annexure “A” and complainant was directed to contact Khan Market Branch and he further reported this complaint to Bank officials as well but OP deliberately did not take any initiative for providing justice to complaint. Ultimately complaint was filed. None appeared for OP1 and was proceedex exparte on 13.12.13. OP2 was discharged earlier on 30.04.13.
As per exparte evidence, it reveals that complainant went to SBI ATM on 30.09.12 at 8:24 PM and swiped Rs.10,000/- in ATM Machine but complainant neither received money nor any slip from Machine. Thereafter he approached HDFC bank ATM and card was swiped for Rs.10,000/- and transaction was successful but balance in account was shown Rs.1,446/- instead of Rs.11,446/- because on that particular day the total balance was available Rs.21,446/- as per Exh.C1/1. Complainant immediately approached Dy. Manager, Axis Bank in Bahadurgarh & complainant was registered but he was advised to contact SBI Bikaner & Jaipur office too. He also approached SBI Bikaner & Jaipur but Manager refused to register his complaint and advised him to contact Axis Bank, Khan Market Branch. Complainant again approached Axis Bank Khan Market after a week when he returned to Delhi and lodged the complaint. Despite visiting the concerned branch a number of times, no action was taken by the bank.
However, while going the Bank account of the complainant, we find that he had also withdraw Rs.10,000/- on 01.10.12 from a ATM at Karol Bagh earlier. In view of this, the case of the complainant he had made only one transaction of Rs.10,000/- is false and the bank statement clearly shows the correct picture. In view of this position, we do not find any deficiency on the part of OP. The complainant is dismissed.
