The Complainant booked in advance two shops on rent in the Mall being constructed by OP in Mohali. The Complainant deposited advance rent for 3 months and security of Rs.1,11,420/- to be refunded on giving possession of shops. The complainant did not see progress and demanded security amount with interest. On not getting it, the complaint was filed. The OP in reply has stated that it was a lease grant of shops to be constructed, with 2 months’ rent free period, before giving possession or construction. There was no service and it was ready to pay back at security without interest.

We have carefully considered the transaction with OP, in the light of documents of leasing and construction of Mall place on record. These are clearly are for taking shops on rent, and payment of advance rent and security. The relationships are in the nature of lessor & lessee on rent charges and did not constitute any ‘service’ within the Consumer Protection Act. The OP in reply has stated that it is still ready to pay Rs.1,11,420/- as sent, without interest. We see no merit in the case. The Complaint is dismissed on non-maintainable.
