Case taken up through video conferencing.

The Ld. Counsel for the complainant has addressed arguments stating that the settlement deed was arrived at with the OP and the cheque issued by the OP for satisfying the settlement had bounced.

Prayer for refund of the amount as per settlement deed with the interest has been made. Heard.

Instant is the case where the settlement had been arrived out of the court and part compliance thereof already made on behalf of OP as also admitted by the complainant. The cheques for remaining amount given by OP bounced .

No deficiency of service by OP in above facts and circumstances of the case are apparent in our considered view.

This Commission is not executing authority for the settlement arrived outside the Commission. Hence, there is no cause of action in favour of complainant and thus, the petition is dismissed, however, the complainant shall be at liberty to address his grievance before the competent court of jurisdiction as per law.
