| Final Order / Judgement | Hon’ble Mr. Ajeya Matilal, Presiding Member The Ld. Advocate for the review applicant is present. In the instant review application, the applicant prayed for setting aside the order dt. 25.11.2022 passed by Ld. DCDRC, Sealdah, Kolkata, Unit IV. Heard the Ld. Advocate. Perused the impugned order no. 13 dt. 25.11.2022. The Ld. Forum below observed: “It is found that by the said order dt. 19.07.2022, Order no. 5, an order of ex parte hearing against OP no. 6 along with four other OPs was passed as they did not appear and file W/V within the stipulated time. Be it noted here, this Commission has got no jurisdiction to recall the aforesaid order. Therefore the instant petition for recalling the said order stands rejected.” We are of the view that the impugned order does not suffer any illegality or irregularity. Accordingly, RP/18/2023 is dismissed and the impugned order is upheld. Let a copy of this order be sent to Ld. Commission below. Joint Registrar is to do the needful in this regard. | |
