The complaint of deficiency is regarding manufacturing defects in the Sony Mobile W595 purchased by complainant from its dealer OP2 for Rs.13,500/- vide receipt Exh.CW1/1. It is alleged that she faced signal problem on buying it, which she thought was because of SIM card or general signal problem. But she found the same despite change of SIM. She took it to authorized service centre OP3, it tried to repair but it again started with screen problems, ultimately, it was diagnosed as a defective set, with manufacturing defects. She approached OP1 for replacement etc without any result. Therefore this complaint.

None of them viz. manufacture, dealer and service centre responded to notice and were proceeded exparte as no reply came on record.

We have considered the complaint and considered the evidence. The same is unrebutted and shows how the complainant suffered due to defective mobile and faced harassment. We hold OP1 guilty of deficiency in marketing a defective mobile and direct it to return Rs.13,500/- to complainant, with interest of 9% from date of complainant till payment. We also award Rs.10,000/- for litigation expenses.

The order shall be complied within 30 days of the receipt of the copy of the order; otherwise action can be taken against OP1 under Section 25 / 27 of the Consumer Protection Act.

File be consigned to record room.

Copy of the order be sent to the parties free of cost.
