The complainant filed this case with the allegation that the complainant had availed the services of the o.p. and booked a consignment containing 2621 retro reflective type structure plate total amounting to Rs. 7,94,294/- and the goods are to be delivered to M/s. Competent Electric System, Bhupal, Madhya Pradesh. The said consignment booked on 27/01/2017 and the amount charged was Rs. 10,936/-. But the said consignment was not reached to the destination for which the complainant filed this case praying for refund of the amount of Rs. 69,064/- and compensation of Rs. 2,00,000/- and litigation cost of Rs. 5,000/-.

On perusal of the record it appears that the consignment was held up by the sales tax authority in Indore for which the complainant was   informed as to why the consignment was not delivered within the stipulated time. Since the clearance of sales tax was required for which the consignment was withheld by the concerned authority. There was no deficiency in service on the part of the o.p. Thereby we hold that the case filed by the complainant is not maintainable since the complainant failed to substantiate the allegation against the o.p. that there was any deficiency on their behalf.

In view of the said fact the case is dismissed in limini.
