          The complainant is a registered Association of the buyers of residential apartments in a project namely ‘Amprapali Golf Homes’, which the opposite party namely ‘Amprapali Smart City Developers Pvt. Ltd.’ was to develop on plot No. GH-02, Sector 4, Greater Noida.  This complaint has been instituted by the above referred society on behalf of 52 allottees of residential flats in the above referred project.  The case of the complainant in nut shell is that after booking of residential apartment with the opposite party, the above referred flat buyers entered into individual buyers’ agreement with the opposite party on different dates.  In terms of Clause 19(a) of the said agreement, the opposite party was to complete the development / construction of the flats within thirty months from the date of starting of excavation / signing of agreement, which could vary ± six months, subject of course to force majeure conditions.  The grievance of the above referred flat buyers is that despite they having made substantial payments to the opposite party, and the date committed for delivery of possession of the flats having expired, the opposite party has not even completed the construction of the apartments.  The complainant is therefore, before this Commission seeking possession of the flats to the concerned flat buyers along with compensation etc.

2.      The opposite party was served with the notice of admission of the complaint on 16.9.2017.  The written version therefore ought to have been filed by 16.10.2017.  The written version however, was filed on 09.01.2018, without an application for extension of time to file the same.  Having been filed beyond the prescribed period, the said written version was rejected vide order dated 11.1.2018 and the complainant was directed to file its affidavits by way of evidence. 

3.      The learned counsel for the complainant states that they have filed affidavits of all the 52 flat buyers on whose behalf this complaint is instituted.  The said affidavits are stated to have been filed along with this complaint itself. 

4.      A perusal of the certificate dated 27.4.2016 issued by the Registrar of Societies, Uttar Pradesh would show that the complainant was registered on 26.4.2016 and the said registration is valid till 25.04.2021.  One of the objects of the complainant as per the amended bylaws dated 03.4.2016 is to file a complaint on behalf of the consumers of the Amprapali Golf Homes against Amprapali Smart City Developers Pvt. Ltd. against unfair trade practices etc.  Therefore, it can be safely said that the complainant is a recognized consumer association within the meaning of Section 12 of the Consumer Protection Act.  The complainant is therefore, competent to institute this complaint on behalf of the above referred 52 flat buyers.

5.      The following are the details of the allotments made to the above referred 52 flat buyers, including the date of application, the date of buyers agreement, the proposed date of possession, the total agreed sale consideration and the amount paid by each of them.

The proposed date of possession given by the complainant does not include the six months period referred in Clause 19(a) of the buyers’ agreement and therefore, giving benefit of the aforesaid six months period to the opposite party, the committed date for delivery of possession would be six months later than the date given by the complainant.      

6.      It is evident from the proposed date of possession given hereinabove, that even after giving benefit of six months to the opposite party, the possession ought to have been delivered in all the cases, before this complaint came to be instituted.

7.      Since the opposite party has failed to offer possession of the flats allotted to the above referred flat buyers, the complainant is entitled to an appropriate order directing the opposite party to complete construction of the flats allotted to the above referred 52 flat buyers in all respects, obtain the requisite occupancy certificate and offer possession therein to the concerned flat buyers.   The said flat buyers are also entitled to appropriate compensation for the period the possession is delayed.

8.      I asked the learned counsel for the complainant as to what would be the appropriate date for directing the opposite party to complete the construction of the flats in all respects, obtain the requisite occupancy certificate and then offer possession to the individual flat buyers.  The learned counsel states on instructions from some of the flat buyers, present in the Court that an outer limit of 31.12.2019 may be fixed by this Commission for the opposite party to complete the construction of all the flats in all respects, obtain the requisite occupancy certificate at its own cost and responsibility and then offer possession of the flats to the individual flat buyers.

9.      The complaint is therefore disposed of with the following directions:

(i)      The opposite party shall complete the construction of the flats detailed in the Annexure ‘A’ on page 20-22 of the paper book in all respects, obtain the requisite occupancy certificate of all those flats at its own cost and responsibility and then offer the possession of the flats to the concerned flat buyers on or before 31.12.2019.

(ii)      The opposite party shall pay compensation in the form of simple interest @ 8% per annum to the above referred flat buyers from the date committed for, for delivery of possession till the date on which the possession in terms of this order is actually offered after completing the construction in all respects and obtaining the requisite occupancy certificate.

(iii)     For the purpose of compensation, the proposed date of possession given in Annexure ‘A’ on page 20-22 of the paper book shall stand extended by six months in each case.

(iv)    The balance amount, if any, payable to the opposite party by the flat buyers shall be adjusted out of the compensation payable to them in terms of this order.  The balance compensation, if any, shall be paid to them on or before the date on which the possession of the flats in terms of this order is offered.

(v)     The opposite party shall pay a sum of Rs.25,000/- as cost of litigation to the complainant.

(vi)    In the event of non-compliance of this order, one or more of the flat buyers mentioned in Annexure ’A’ referred hereinabove, shall be entitled to approach this Commission, seeking execution of this order.
