The complaint pertains to deficiency in service on part of OP for loss of baggage.
The complainant travelled from Sri Nagar to New Delhi on 13.10.14 by Air India flight. On reaching Delhi Airport her baggage was found missing and a complaint was made to OP authorities. Her baggage contained items and clothing of daily use. It also contained important and original document i.e. her Degree Certificates, Registration Certificates for BSc., Marks Sheet for Nursing Course, passport and her medical record.
OP in its letter dated 23.2.15 admitted that complainant travelled on 13.10.14 and her baggage weighing 20 KG was lost and Property Irregularity Report was issued. It also admitted that baggage is untraceable till date.
Perusal of file and after giving due consideration to submissions made by both parties reveal that OP had agreed to pay compensation for 450/Kg along with one air ticket as compensation. Loss of baggage is thereby admitted. The complainant being a young girl lost her original degree certificates and has to run from pillar to post to get duplicate certificates issued from competent authorities. Merely paying 450/Kg will not adequately compensate the trauma, agony and inconvenience suffered by her due to deficiency in service on part of OP during course of journey.
OP is, therefore, found guilty of imperfection in service and is directed to pay Rs.50,000/- as compensation for negligence, inaction and passivity in their non efforts to trace the missing baggage. We also award Rs.10,000/- for litigation expenses.
The order shall be complied with within 30 days of the receipt of the copy of the order; otherwise action can be taken under Section 25 / 27 of the Consumer Protection Act.
Copy of the order be sent to the parties free
of cost.
