The Complainant had a membership of OP on road assistance helpline under the name of Cross Roads in Delhi and NCR, for 10 years by paying a membership fee against card no.70001489, valid till July 20, 2013. His car broke down on 09.07.13, near Inderlok Metro station at 7:30 PM, when it was also raining heavily. His repeated requests for help were turned down, and he was informed that his card had expired on 04.07.13. The Complainant called a mechanic and paid him, to get car repaired. On verification he found his car still valid. The OP did not help for want of card no. with him at that time. Therefore this complaint of deficiency.

The OP is exparte. We have considered the email correspondence placed on record between the parties. These show that OP’s database was not correctly maintained. There was confusion in their office records, because of which, complainant could not avail services, when most needed. He has proved by documents of Bank that he regularly paid his membership.

We hold OP liable for deficiency in services to their membership card holder by not providing assistance, on an excuse of not remembering card no., despite car record with it. We award compensation of Rs.7,500/- for the suffering of complainant and award Rs.5,000/- as litigation expenses.

The order shall be complied with within 30 days of the receipt of the copy of the order; otherwise action can be taken against OP under Section 25 / 27 of the Consumer Protection Act.

File be consigned to record room.

Copy of the order be sent to the parties free of cost.
