        The deficiency pointed out in the complaint relates no issuing an insurance policy by the OP, without any request from the complainant, who was solicited by OP to take a credit card, in the name of “Freedom Card”. The OP issued a statement showing debit of Rs.4,842/- towards ICICI Lombard Health Policy on card no.541538231548 4766. He protested & lodged complaint, and he was given complaint no.00026000474, vide Annexure A1 to complaint but despite that the policy was not cancelled and he continued receiving bills.

        We have considered the evidence on record filed by OP, in reconstructed file, when original file was not traceable. The reply does not explain the issuing of policy without request. After considering the entire evidence, we find that OP has acted unfairly to sell a policy for unfair gain by debiting the a/c of complainant. We direct OP to return Rs.4,842/- to complainant with interest of 9% from date of debit and also pay Rs.3,000/- towards deficiency and litigation expenses.

The order shall be complied within 30 days of the receipt of the copy of the order; otherwise action can be taken under Section 25 / 27 of the Consumer Protection Act.

File be consigned to record room.

Copy of the order be sent to the parties free of cost.
