Final Order / Judgement

None is present on behalf of the parties. Today is fixed for showing cause by the complainant.

Record reveals that the complaint was filed in the year 2012 before the Ld. District Forum, Barasat (Commission as amended). After establishment of this Ld. Commission the case record has been transferred from the said Ld. Commission, Barasat to this Ld. Commission in view of the order passed by the Hon’ble SCDRC. The record is received by this Ld. Commission on 16.12.2020. Accordingly parties were directed to appear before this Ld. Commission. On 21.01.2021 the complainant was present. Record reveals that on 27.09.2016 complainant was directed to take necessary step in respect of service of notice upon the OPs.

After completion of S/R the complainant had prayed for appointment of Ld. Commissioner. From this stage the complainant did not take any positive step to proceed with this complaint. After remitting this case in this Ld. Commission though the complainant appeared but no positive action was taken by him. On earlier date i.e. on 07.09.2021 due to absence of the complainant he was directed to show cause as to why the complaint shall not be dismissed. For showing cause date was fixed on 28.10.2021. On 28.10.2021 the complainant remained absent without taking any step.

Under the circumstances we have no other option but to dismiss the complaint for default due to absence of the complainant and non compliance of the Commission’s order. It is clear to us that the complainant has lost his interest to proceed with this complaint.

Going by the foregoing discussion, hence it is ordered that the Consume Complaint being No. RBT/CC/389/2020 is hereby dismissed for default. There is no order as to cost.

Let plaint copy be given to the parties free of cost as per CPR.
