JUDGMENT

1. The present complaint has been filed by the complainant before this commission for  the following reliefs-

1. The Op be directed to supply the stitched garments or to return the amount Rs.30000 with interest @ 18% per annum from 14.7.2021 till payment.
2. The op be directed to pay litigation expenses Rs.10000.

2.  Complainant has stated that he contacted the OP for the purchase of stitching garment and paid the amount Rs.30000 for material and stiching lobour to supply the stitched garment. OP carries on the business of supplying the stitched garments on payment of cost of the material and stitching  lobour. Complainant had paid the amount Rs.30000 on 14.7.2021 from his account maintained in HDFC Bank. Complainant approached the OP serveral times either to supply the garments or to refund the money but he falied to render services .
3. Op does not file WS despite of sufficient service.                               
4. Complainant has filed his affidavit and papers in support of his pleadings.
5. We have perused the material available on record and heard the complainant.
6. There is no rebuttal of the pleadings made by the complainant and the complaint’s case stands proved against the Op. Op is liable to supply the garment to the complainant within a month or to refund the amount Rs.30000 with interest.
7. We hereby direct op either to supply the garment within a month or to refund the amount Rs.30000 . Op is  also directed to pay Rs.5000 as litigation expenses to the complainant.
8. A copy of this judgment be provided to all the parties as per rules as mandated by Consumer Protection Act, 2019. The judgment be uploaded forthwith on the website of the commission for the perusal of the parties.
