          Both parties are absent.

          This appeal is directed against the order dated 24/03/2003 passed in consumer complaint No.53/2002, Shivashis S. Ghoshal V/s. M/s.Yashashree Construction through its Partners, passed by District Consumer Disputes Redressal Forum, Raigad at Alibag (‘the Forum’ in short).  The consumer complaint stood dismissed and feeling aggrieved thereby, org. complainant preferred this appeal.

          We have carefully considered the papers on record.  In the instant case, appellant/complainant failed to substantiate his alleged grievance of reduction of width by creating obstruction through installed beam and certain other amenities.  The Forum after scrutinizing the material placed before it came to the conclusion that the appellant/complainant’s agreement with the opponent does not reflect any commitment regarding alleged deficiency and therefore, since complainant failed to substantiate his claim, the Forum dismissed the complaint.  It is also pointed out by the Forum that references to the deficiencies which are alleged are not correlates with the complainant, but with somebody else.  Under the circumstances, we find no reason to take a different view than what has been taken by the Forum.  Appeal is devoid of any substance and hence, we pass the following order :-

                   -: ORDER :-

1.       Appeal is not admitted and stands dismissed.

2.       No order as to costs.

3.       Copies of the order be furnished to the parties.
