Sh, Rakesh Jaiswal, counsel for opposite party(opposite party ex-parte vide order dated 14.5.2024).
ORDER:
Today the case was fixed for filing evidence on behalf of the complainant.
Complainant has tendered an affidavit Ex.CW-1 alongwith documents Ex. CW-1 & CW-2 in his evidence and close the same on behalf of the complainant. Accordingly, evidence on behalf of the complainant has been closed.
On the other hand, Shri Rakesh Jaiswal, counsel for opposite party (Opposite parte ex-parte vide order dated 14.05.2024) appeared and suffered a statement that we are ready to replace the washing machine in case the complainant ready to pay depreciation amount of 40%. In that case company will replace the same to the complainant with old one.”
Considering the statement of Shri Rakesh Jaiswal, counsel for the opposite party (Opposite party vide order dated 14.05.2024), Brij Mohan Mittal complainant has made a statement that he is ready to pay the depreciation amount of 20% and ready for replacement of washing machine after return the old one.
On the basis of the statement of the complainant, the Commission is of the opinion that the complaint is disposed off with the direction to opposite party to replace the washing machine in question after deduction of 20% of the invoice amount, subject to return the old one. There are no order as to costs. Compliance of this order be made within 30 days from the date of receipt of copy of this order. Copy of this order be sent to the parties concerned free of costs. File be consigned to the record room.
