ORDER
DISTRICT CONSUMER DISPUTES REDRESSAL COMMISSION: NORTH-EAST
The Complainant has filed the present complaint under Section 35 of the Consumer protection Act, 2019.
The case of the Complainant is that he was purchased a whirlpool Refrigerator and the same was not cooling so Complainant lodged complaint at Customer care on 22.11.22 vide ticket no. DEL-22112238747 then the technician named Malkeet Singh visited house of Complainant and changed compressor and fan by charging Rs. 9,465/- vide bill/invoice no. KN/22-23 dated 23.11.22 and Complainant is provided with 5 year warranty for compressor and 1 year warranty for fan. The Complainant stated that a problem of disturbing noise occurred from refrigerator and Complainant made another complaint on 24.11.22 vide ticket no. SWL24112263304 and the same technician visited and resolve the issue of noise but then the refrigerator stopped cooling. Complainant made repeated complaints and made many calls to Opposite Party but no technician visited his home than another technician Atul Sharma informed Complainant that refrigerator has internal leakage problem and there was no need to change compressor and fan. Thereafter, the Complainant lodged many complaints on various dates to Opposite Party but all in vain. On 31.12.22 Complainant again made a complaint but no response was received. The Complainant stated that on 07.01.23 he had served a legal notice to Opposite Party but Opposite Party did not give any reply to that. Hence, this shows deficient on the part of Opposite Party. Complainant has prayed to reimburse Rs. 12,065/- and Rs. 1,00,000/- towards mental agony. He has also prayed for Rs. 11,000/- as litigation expenses.
The Complainant did not produce any invoice or warranty card of the Refrigerator purchased from Opposite Party No.1. So he failed to make any case against Opposite Party No.1 for deficiency of service. Complainant failed to produce any document of 5 year warranty for new compressor and 1 year warranty for the fan along with complaint.
In view of above discussion, we did not see any ground to admit the complaint. The complaint is dismissed.
