The complaint pertains to defect in refrigerator. The complainant brought a refrigerator on 25/10/2012 for a sum of Rs.18,000/-. It submitted that the door of the refrigerator was not closing and it was not cooling properly. The refrigerator was replaced by OP on 17/11/2012. It is stated that the replaced refrigerator was not working properly and various complaints regarding the same had been lodged with customer care executive. The complainant prays for refund. Complainant has filed bill dated 25/10/2012, replacement advised dated 5/11/2012 and complaint dated 14/5/2013.
OP in its reply has stated that no complaints were ever registered. It is stated that all technical or mechanical defects were attended by the engineers. In fact, no complaint has been registered after the replacement of product on 17/11/2012.
It is clarified that a 12 digit number along with satisfaction code is given to every complaint but no such complaint number is mentioned. It is also stated that if at this stage, there is any problem in the working of refrigerator, OP is ready to repair the same. It is submitted that no documentary evidence or expert report from approved laboratory is filed.
It is emphasised that the refrigerator was purchased on 25/10/2012. There was dent in the body of refrigerator which occurred in the course of transportation. Subsequently, the product was replaced on 17/11/2012.
We have considered the pleadings filed by both the parties. It is admitted that refrigerator was purchased on 25/10/2012. The same was replaced on 17/11/2012. The complainant has placed a complaint dated 14/5/2013 which is addressed to the manager of OP1. The complainant has not filed any proof of service of this complaint. OP has denied receiving any complaint. The complainant has also stated that he has made multiple complaints to customer care executive but no complaint has been filed. In fact OP has submitted that a complaint number is generated after every complaint. The complainant has not given any details of such complaint number in the rejoinder filed by him.
Hence, the complaint being devoid of merits is dismissed. File consigned to record room.
Copy of order be sent to the parties, free of cost, and thereafter file be consigned to record room.
