The case of the complainant is that on 09.07.2009 vide bill no.244, she purchased a computer bearing model name King Cobra from OP for a sum of Rs.13,500/-. In August 2011 the monitor of the computer started troubling and same was turning off automatically. No picture was coming up on desktop. The computer was taken to OP and OP assured to replace the defective part. The computer was returned on 01.9.11 in the same condition and it was further told that desktop cannot be replaced as the same required additional expenditure of about Rs.3,000/-. The complainant again contacted OP but of no use. Ultimately this complaint has been filed for deficiency in service on the part of OP. It is prayed that OP be directed to pay Rs.13,500/- alongwith interest of Rs.5265/- plus Rs.20,000/- towards compensation, litigation charges etc.
OP in the reply took the plea that OP never sells computer as it is not authorised to manufacture the same but he was selling only the parts of the computer and all computer parts comes with the warranty to be replaced by the manufacturer. The OP has sold the parts only and it is the party who has themselves assembled the computer. It is denied that complainant ever approached the OP regarding problem of monitor. It is submitted that complaint be dismissed.
We have carefully perused the record.
Complainant has placed on record the bill showing that she has purchased a computer for a sum of Rs.13,500/-. In that bill a warranty period against the parts of the computer is mentioned and in respect of monitor, it was for three years. In fact against each part the price of the part is not mentioned but the warranty period of the part is mentioned. It itself shows that the computer was sold by OP and for each part warranty has been mentioned. Complainant has placed document on record to show that the computer was handed over to OP and the same was returned on 01.09.2011. There is no reason to disbelieve the complainant that the computer was not repaired and parts were not replaced. It is a clear cut case of deficiency in service on the part of OP.
OP is directed to pay a sum of Rs.13,500/- to complainant alongwith interest @ 9% p.a. from the date of filing of the complaint. OP is also directed to pay Rs.3,000/- towards litigation expenses.
On the receipt of the amount, complainant shall return the computer to OP.
Let the order be complied within one month of the receipt thereof. The complaint stands disposed of accordingly.
Copy of order be sent to the parties, free of cost, and thereafter file be consigned to record room.
