A joint compromise application has been moved by the appellant – opposite party Sh. Ashok Yadav, Proprietor, Om Marbles and respondent – complainant Smt. Vijay Sharma, Proprietor, M/s Vijaya Traders.  The signatures of respondent – complainant Smt. Vijay Sharma, Proprietor, M/s Vijaya Traders have been identified by Sh. Sudeep Kandwal, Advocate and the signatures of Sh. Ashok Yadav, Proprietor, Om Marbles, have been identified by Sh. J.K. Jain, Advocate.

By way of the compromise, both the parties are agreed that sum of Rs. 75,000/- shall be paid by the appellant to the respondent – complainant Smt. Vijay Sharma before this Commission in full and final satisfaction of the claim.

Compromise application is allowed. 

Respondent – complainant Smt. Vijay Sharma, Proprietor, M/s Vijaya Traders, has received the amount of Rs. 75,000/- in cash from the appellant Sh. Ashok Yadav, Proprietor, Om Marbles, before this Commission in full and final satisfaction of the claim.

The impugned judgment and order dated 13.10.2014 passed by the District Forum, Haridwar in consumer complaint No. 362 of 2013 is modified in terms of the above compromise arrived between the parties, which shall form part of the order.  The appeal is accordingly decided in terms of the compromise.

The statutory amount of Rs. 25,000/- deposited by the appellant at the time of filing the appeal as well as further amount of Rs. 4,00,000/-  deposited by the appellant in compliance of order dated 03.11.2014, be released in favour of the appellant.  No order as to costs.
