ORDER

This judgement is pronounced in the open court on seperate sheets of paper today. This complaint is allowed in part. Opposite party's letter No.070600/11399/95/96-97 dt. 13.8.94 along with the discharge voucher sent with it are here by quashed. Opposite party is directed to settle the claim on total loss basis and pay Rs.3,19,500/- along with interest at 10% p.a. from 13.8.96 to the date of payment. The opposite party is also directed to pay Rs.500/- as cost of this proceedings to the complainant. It is further ordered that these amounts shall be paid to the complainant within 2 months from the date of receipt of copy this order and upon receiving these amounts the complainant return the salvages mentioned in the surveyor report to the opposite party. The other reliefs prayed by the complainant are rejected.
