The appellant is the complainant in CC.21/07 in the file of CDRF, Alappuzha.  The complaint stands dismissed noting that both the parties were absent. 

2. It is submitted by the appellant/complainant that the complainant had adduced evidence and that the counsel for the complainant was present and that only the opposite party was not present on the particular day.

3. We find that none of the above facts are mentioned in the order.  In the circumstances the order of the Forum is set aside.  The Forum is directed to issue notice to the opposite party and dispose of the matter after permitting both sides to adduce further evidence if they so desire.  The matter stands posted before the Forum on 20/10/2010.

 The office will forward copy of this order to the Forum.
