ORDER

Claimant is present; Ld. Advocate for Claimant is also present.

Ld. Advocate for the M/S Trip to India Tours is present.

Ld. Lawyer of both parties consented before this court that the matter has been settled between the parties for the amount of Rs. 10,000/-  (Ten thousand) only It is pertinent to mentioned here that the OP has paid a sum of Rs. 25,000/- on 18.03.2021 vide order no. 8 dtd. 18.03.2021. Hence they prayed to pass necessary order to that effect.

On perusal of letter given from the side of M/S Trip to India Tours & Travels  it appears that the matter has been settled between the parties for further amount of Rs. 10,000/-  (Ten thousand) only.

Hence we think it is fit case it should be disposed through Lok Adalat for the settled amount.

Hence it is

ORDERED

 

Accordingly the instant case is disposed of through Lok Adalat.

Claimant, Swarup Dutta, Sri Tarun Dey & Sri Mantu Dutta, is entitled to get Rs. 10,000/- (Ten thousand) only as compensation from M/S Trip to India Tours & Travels.

OP No. 2 Palash Roy is directed to issue one chaque of Rs. 10,000/-  (Ten thousand) only in the name of the claimant Swarup Dutta, Sri Tarun Dey & Sri Mantu Dutta within one week from the date of passing of this order failing which the award amount will carry interest at the rate of 9 per cent per annum.

If Insurance Company failed to pay the awarded amount, then claimant will be at liberty to execute the order/decree through due process of law.
