Final Order / Judgement

The complainant is absent without steps.

The Ld. Advocate of OP no. 4 is present. The case is running ex parte as against OP no. 3 and the process for causing service of notice upon OP no. 1 and 2 is yet to be completed.

But the complainant has not comply with the direction for causing service of notice upon OP no. 1 and 2 and also the direction for showing cause as to his repeated absence before this Commission. The complainant has neglected to comply with the aforesaid 2 directions.

It seems to us that the complainant is no more interested to proceed with the case and for that it is not possible for this Commission to run the case with the repeated absence of the complainant. We think that this is a fit case for passing a dismissal order.

Hence it is ordered that the case be and the same is dismissed for non-prosecution; but without cost.

Let a plain copy be given to the parties fee of cost as per CPR.
