                   Heard learned counsel for the parties.

                   This revision petition is filed by the complainant/petitioner challenging the order dated 23.07.2018 passed by the District Consumer Disputes Redressal Commission, Bhopal (For short District Commission) in C.C.No.55/2018 whereby the District Commission has rejected the complainant’s application seeking non deduction of monthly instalments from the complainant’s salary towards repayment of the housing loan availed by the complainant in the year 2005. 

                  After hearing learned counsel for petitioner and having gone through the

impugned order and the facts of the revision petition. we observe that the District Commission has rightly dismissed the application in view of the fact that the matter is regarding settlement of housing loan and the outstanding amount against the housing loan availed by the complainant, which can be decided since the opposite party has already filed reply to the complaint.

                   In view of the aforesaid, we remand the matter back to the District Commission for decision on merits.  All contentions of the parties are left open.  Parties are at liberty to file additional evidence, if any, in support of their contentions. 

                 Parties are directed to appear before the District Commission on 29.09.2020. Record of the District Commission be sent at the earliest.

                 The District Commission shall proceed with the matter in accordance with law.

                  This revision petition is accordingly disposed of.
