This order shall dispose of present complaint after affording preliminary hearing to the counsel for the complainant.

During preliminary hearing, counsel for the complainant has argued that his insured vehicle bearing No.PB-03AW-7168 met with an accident with tractor/trailer. The complainant have intimated the same to opposite parties, but they have failed to settle the claim till date. The complainant has suffered from mental tension, agony, harassment and humiliation.

We have heard learned counsel for the complainant and gone through the record.

Perusal of file shows that the complainant has not lodged the formal insurance claim with opposite parties till date. Therefore, this Commission is of the view that complaint is pre-mature at this stage. As such, without going into merits of the case, the complainant is directed to lodge the insurance claim with opposite parties and opposite parties will settle the claim of the complainant within 30 days from the date of receipt of claim from the complainant. As such, this complaint stands disposed off.

Copy of order be issued to parties free of cost and file be consigned to record room.
