Dt.29.04.16. The complainant’s case in brief is that he had obtained possession of the property as mentioned in this petition of complaint from the OP, but he complains that even though he paid proper maintenance charges, yet he did not obtain basic services, which is well within his right. The complainant incurred huge expenses towards repair of the building, and he claims that the structure appears to be quite weak. He accordingly files this case praying that the OP be directed to provide him compensation of Rs.1,00,000/- for the harassment he suffered, and he also prays for litigation expenses of Rs.50,000/-.
The case has been heard exparte.
To prove the case, there is no original document in the record. Neither the titled deeds, nor the agreement with the OP showing terms and conditions therein have been filed by the complainant. Accordingly, complainant fails to prove the case by adducing proper evidence i.e., documentary evidence in original.
So, the case fails for want of evidence.
Hence, it is
O R D E R E D
that the Consumer Case No.17/S/2014 is dismissed exparte against the OP.
Let copies of this order be supplied to the complainant free of cost.
