                         ORDER

 

1.                     This case has been taken up today in the Lok Adalat. Efforts were made to settle the matter, which stood fructified and the parties have settled the dispute. Statement given by them is reproduced as under:-

“Statement of Sh.Sandeep Suri, Advocate for OP.

 

The matter has been settled between the parties. As per settlement, the OP shall reverse the charges levied in the account under the heading Legal & Retainer Charges and give due benefit to the complainant and as agreed between both the parties shall also issue a letter to the concerned insurance company for the purposes of rectification of the objections raised vide Annexure C-6. The complainant shall provide a certified notarized copy of the Registration Certificate to the OP for the purposes of transmission to the concerned Insurance Company. If any objections are required to be cleared by the complainant, as may be raised by the Insurance Company, the required documents will be supplied by the complainant to the OP/Insurance Company. The OPs have also agreed to pay a sum of Rs.3500/- towards compensation to the complainant in full and final settlement within three weeks from today i.e. 13.8.2010.

I accept the above statement given by Sh.Sandeep Suri, Advocate for OP, in case the statement of accounts are provided to the complainant showing the reversing of entries in dispute and further issuing of process for the rectification of the objections raised vide Annexure C-6 alongwith compensation so agreed.  The complaint may be disposed of accordingly.

 

2.                     In view of the above statements, the complaint stands disposed of. The OP OP would reverse the charges levied in the account under the heading Legal & Retainer Charges and give due benefit to the complainant and as agreed between both the parties, would also issue a letter to the concerned insurance company for the purposes of rectification of the objections raised vide Annexure C-6. The complainant would provide a certified notarized copy of the Registration Certificate to the OP for the purposes of transmission to the concerned Insurance Company. Further, if any objections are required to be cleared by the complainant, as may be raised by the Insurance Company, the required documents would be supplied by the complainant to the OP/Insurance Company. The OP would also pay a sum of Rs.3500/- towards compensation to the complainant in full and final settlement within three weeks from today i.e. 13.8.2010. 

3.                     Copies of this order free of cost be supplied to the parties. The file be consigned.
