Complainant and his counsel called out absent.  No representation on behalf of complainant.

On perusal of the order sheet, it is noticed that this case was posted for filing affidavit of complainant on 29.07.2021 since that till today in spite of lapse of more than 1 ½ years, the complainant does not turned up and not filed affidavit in spite of sufficient opportunity was given. 

On the last date of hearing on 23.05.2022 this case was adjourned on payment of Rs.750/- payable by the complainant to OP and posted the matter for filing affidavit of complainant as a last and final chance.  Even then, the complainant not present and not filed affidavit, it shows that the complainant is not interested to proceed with the case.  In view of non-filing of the affidavit of complainant, the complainant has no case at all.  Therefore, the complaint of the complainant is dismissed for default as well as for non-prosecution.
