ORDER:
Today the case was fixed for arguments.
Instead of arguing, Shri Amar Nath s/o Sh. Chandrika Parsad, R/o H.No. 406, Bali Nagar,, Palwal – opposite party No.2 has made a statement that “the cheque bearing No. 010933 dated 30.11.2019 amounting of Rs.331250/- drawn on ICICI Bank, Palwal issued by me in favour of complainant as a security and since, now compromise has been arrived at between the parties, The said complaint filed by the complainant in the court of JMIC, Faridabad u/s 138 NI Act be withdrawn from the said Court before making the payment of Rs.11,00,000/- to the complainant as settled.
Shri Anil Kumar Vaish, counsel for opposite party No.1 has made a statement that “I being the authorized representative of M/s. Tarang Infrastructure, am ready to settle the matter for Rs.11,00,000/- as full and final settlement towards the claim of the complainant in the present matter. A period of 10 days may kindly be granted to make the payment of said settlement amount by the insurance company.
Shri D.P. Gautam, counsel for the complainant has made a statement that “I have heard the statement of counsel for opposite parties Nos.1 & 2 and ready to settle the matter for Rs.11,00,000/- on behalf of the complainant, as full and final settlement towards the claim of the complainant. Order may be passed accordingly. I will withdraw the case filed in the Court of JMIC, Faridabad titled as “Deepka Kardan Vs. Amar Nath’ u/s 138 NI Act after receipt of Rs.11,00,000/-.
On the basis of the statement of the counsel for the complainant, the Commission is of the opinion that the complaint is disposed off with the direction to opposite party No.1 to pay Rs.11,00,000/- within 10 days
from the date of this order. There are no order as to costs. Copy of this order be sent to the parties concerned free of costs. File be consigned to the record room.
