Today is fixed for admission hearing.
After hearing the Ld. Advocate of the complainant and perusing the material placed before us, we find that air tickets purchased at Rs. 28,063/- on 06.11.2019 from the Op 1 are the subject matter of this case.
It is the specified case of the complainant that the price of the tickets has not been refunded although the journey, for which the tickets were purchased, was not taken up.
It is contended by the Ld. Advocate of the complainant that the Op 1 got those tickets cancelled after receiving information of the non-performance of the journey by the complainant. But the record reveals no documents to show that the tickets were cancelled or that refund of the price of the ticket with or without deduction was made in favour of any of the Ops. The letter to which reference has been made by the Ld. Advocate was issued in November 2021- although the purchase of tickets was made on 06.11.2019.
In the absence of documents to show up cancellation of the tickets or collection of refund money, we are unable to say that the complainant has got a good case to proceed. We think that this is a fit case where a dismissal order should be recorded.
Hence it is ordered that the case be and the same is dismissed as being not admitted.
Let plain copy be given to the parties, free of cost, as per CPR.
