Final Order / Judgement

Heard on the objections moved by JDs regarding the execution of the order dated 07.12.2012 according to which it was ordered that the JDs are liable for making payment of interest @10% per annum on the balance sale price to be paid by the DH and execution in this regard was preferred in which the objections has been filed by Jds but during the course of arguments it was amicably settled between DH and JDs that the Jds shall deposit the amount of Rs.10,73,500/- @12% per annum from the date of making payment till its actual realization. The DH has also agreed regarding the above said contentions and admitted that he is ready to accept Rs.10,73,500/- along with interest @ 12% per annum from the date of first payment till its actual realization.

In view of the amicable settlement between both the parties, if is ordered that the JDs shall deposit the total amount i.e. 10,73,500/- along with interest @ 12% per annum from the date of first payment till its actual realization within 60 days from the date of receipt of copy of this order. However, Jds are also directed to deposit litigation expenses Rs.5,500/- to the decree-holder. In case, the JDs did not deposit the above-said amount, then the JDs shall make payment the above said amount @ 18% from the date of after 60 days of receiving of this order.

Parties shall be bound by their statements. Copy of this order be supplied to the parties free of costs. File be consigned to record-room after due compliance. However, Decree holder will be at liberty to file the fresh execution in case of non-payment by the JDs.
