26/03/2008 Complainant/By Sri:- IP Opposite Party/By Sri:- ORDER This complaint is filed for recovery of Rs.1,000/- paid to the opposite party. The facts of the case are that, the opposite party agreed to provide service of cook at the house of complainant at the rate of 1,500/- p.m and annual charge of Rs.2,000/-. Complainant signed the documents and he has paid Rs.1,000/- towards annual charge. On 26th January-2008 the cook by name Smt. Yamuna came to house of complainant and provided the service. On 27th January-2008 onwards the cook has not come to provide service and on contact Mr. Raju maintained that they will refund the amount but failed to do so. Hence, the complaint. The opposite party has not appeared and contested the matter. The case made out by the complainant has gone unchallenged. The complainant has produced receipt dated 23/1/2008 for Rs.1,000/-. Since the main servant left the service and she has given service only for one day. Therefore, it is the duty and obligation of the opposite party to refund the amount received from the complainant. The opposite party by remaining absent had accepted the case of the complainant. If there was any defence to the opposite party he could have appeared and contested the matter. Therefore, by looking into the documents and also the affidavit filed by the complainant it would be just fair and reasonable to order the opposite party to refund Rs.900/- to the complainant. In the result, I proceed to pass the following:- ORDER 3. The complaint is allowed. The opposite party is directed to refund Rs.900/- to the complainant within 15 days from the date of this order. The opposite party is directed to send or pay the amount to the complainant directly with intimation to this Forum. 4. Send the copy of this Order to both the parties free of costs immediately. 5. Pronounced in the Open Forum on this 26TH DAY OF MARCH 2008. Order accordingly, PRESIDENT We concur the above findings. MEMBER MEMBER
