O R D E R

RAM SINGH CHAUDHARY, JUDICIAL MEMBER:

                   As per order dated 27.09.2021 contained in letter No.1578, I am conducting these proceedings singly.   

2.                Due to Covid-19 pandemic, the matter could not be taken up on 19.05.2020, 31.08.2020, 17.11.2020, 04.02.2021, 26.04.2021 and thereafter on 26.04.2021 the matter was adjourned for 08.10.2021.

3.                File taken up today on the miscellaneous application bearing No.248 of 2021 field by learned counsel for the applicant-complainants seeking permission to withdraw the present complaint No.384 of 2019, from this Hon’ble Bench with the liberty to file afresh before appropriate authority.

4.                Heard on the above said application. Keeping in view of the contents of the applications and the contentions raised by learned counsel for the applicant-complainants present miscellaneous application bearing No.248 of 2021 stands allowed and disposed off accordingly.

5.                Learned counsel for the complainant has also suffered a statement to the effect that he may be permitted to withdraw the present complaint with liberty to file afresh before appropriate authority on the same cause of action. His statement in this regard recorded separately.

6.                In pursuance of the respective statement made by learned counsel for the complainant, the present complaint is hereby stands dismissed as withdrawn with liberty to file afresh on the same cause of action before appropriate authority. However, limitation would not be a rider in filing afresh complaint.
