ORDER

Complaint is filed claiming total compensation of Rs.1,325/- on the ground of defective chappals sold by the opposite party. It is the case of the complainant that on 8.2.1995, he purchased a pair of chappals from lthe opposite party company for Rs.325/-. The opposite party agreed to exchange chappals if any defect was noticed within 3 months. Unfortunately the chappals expanded obnormally within a week of purchase and could not be used. Therefore the complainant has sought for refund of the price of the chappals and for compensation of Rs.1,000/- for mental agony and inconvenience caused to him. The opposite party has been duly served with the notice of the complaint. He has not chosen to file his version. Complainant was called upon to lead evidence on affidavit to prove his case. He has not chosen to adduce any evidence nor has he chosen to produce the alleged defective chappals despite issue of notice to produce the chappals. In the circumstances we hold that the complainant is not entitled to any relief. Therefore the complaint is dismissed.
