Learned counsel Sh. Shameem Kashif for the appellant, learned counsel Sh. Kushal Gulati for respondent No. 1 and learned counsel Sh. Sahil Gulati for respondent No. 2 have appeared.
Today a compromise (paper No. 69) alongwith draft bearing No. 187975 dated 17.05.2023 for a sum of Rs. 1,25,000/- (Rupees One Lakh Twenty Five Thousands only) has been submitted; the above draft be given to the learned counsel for the appellant on behalf of the appellant.
The terms and conditions of the compromise (paper No. 69) are explained and read over both the parties’ counsel who have accepted the terms and conditions of the compromise after perusing and understanding it and made their signatures thereupon.
As the terms and conditions have been admitted by both the parties, hence the appeal deserves to be decided in terms of above compromise.
Accordingly, the compromise is accepted and the appeal is decided in terms of compromise. Compromise shall form part of the order.
Both the parties shall bear their own litigation charges.
Statutory amount, if any, deposited by the appellant be returned to the appellant, as per rules.
File be consigned to the record room alongwith copy of this order.
A copy of this order alongwith copy of compromise and original record be sent to the District Commission concerned for perusal and necessary information.
