ORDER

PER SANJEEV BATRA, PRESIDENT

1.                           The complainant has invoked the jurisdiction of this Commission by raising a consumer dispute against the OPs with regard to non-settlement of claim of minor daughter of complainant by the OPs and sought direction against OPs to make payment of Rs.32,593/- with interest along with compensation and litigation expenses etc. So, by filing the present complaint, complainant has prayed that OPs be directed to make the payment of Rs.32,593/- along with interest of @18% per annum from the date of submission of claim upto date. Also to pay Rs.1 lac as compensation and Rs.15,000/- as litigation charges

2.                Notice was issued to the opposite parties. On 03.07.2023,  Sh. Rajeev Abhi, Advocate counsel for OPs appeared and filed application to put up the file. Upon application of the counsel for the OPs, file was taken up on 03.07.2023 and Sh. Rajeev Abhi, Advocate counsel for the OPs suffered statement that the OP is ready to pay Rs.28,548/- as full and final settlement of the claim as per settlement bill assessment sheet Ex. RA and settlement of present complaint. He further stated that the OP will make the payment within 30 days from the receipt of copy of order.

3.                The said offer has been duly accepted by complainant by suffering separate statement in this regard. Complainant Sh. Ramesh Kumar along with counsel Sh. Sachin Vasudeva, Advocate also suffered statement by accepting Rs.28,548/- in full and final settlement of his claim and redressal of his grievance and present complainant. The complainant also prayed for passing award of Rs.28,548/-.            

4.                In view of the aforesaid settlement arrived between the parties through Ex. RA, the present complaint stands disposed of with the direction that the OPs will pay Rs.28,548/- to the complainant in full and final settlement of his claim within 30 days from the date of receipt of copy of this order. Copy of the order be supplied to the parties free of costs.

5.                File be indexed and consigned to record room.

                   On 03.07.2023 the file was taken up on the application moved by Sh. Rajeev Abhi, Advocate counsel for applicant and he also suffered statement that the OP is ready to pay Rs.28,548/- as full and final settlement of the claim as per settlement bill assessment sheet Ex. Ra and settlement of present complaint. He further stated that the OP will make the payment within 30 days from the receipt of copy of order.

                   Complainant Sh. Ramesh Kumar along with counsel Sh. Sachin Vasudeva, Advocate suffered statement by agreeing and accepting Rs.28,548/- in full and final settlement of his claim and redressal of his grievance and present complainant. The complainant prayed for passing award of Rs.28,548/-.

                   We have perused the record. Vide separate detailed order of today,  the present complaint stand disposed of. Copies of order be supplied to parties free of costs as per rules. File be indexed and consigned to record room.
