Rajeev Gupta Vs M/s. Star Health & Allied Ins. Co.Ltd.

 

Present:- Sh.Vikas Kumar Gupta, Adv. Counsel for Complainant.

Sh.Nitish Arora, Adv. Counsel for Opposite Party.

 

Today, Statement of Sh.Nitish Arora, Adv. Counsel for Opposite Party recorded that the Company is ready to settle the matter with the complainant in full & final settlement against the claim of the complainant (remaining Hospitalization charges) for an amount of Rs.18,500/-. The company shall make the said payment within 45 days from today on receiving cancelled cheque and Pan Card of the Complainant.

Further, Statement of Sh.Vikas Kumar Gupta, Adv. Counsel for Complainant recorded to the effect that he has heard the statement of Counsel for OP and admit the same to be correct. He withdraws the present complaint reserving the right to claim remaining post hospitalisation charges by raising the claim with the Opposite Party.

In view of statement suffered by Counsel for Complainant as well as Counsel for OP and the fact that the good sense has prevailed upon the parties and they have settled the matter amicably, the award is passed with the directions to the OP to pay the aforesaid amount of Rs.18,500/- to the complainant within 45 days from today on receiving cancelled cheque and Pan Card of the Complainant. The present complaint is accordingly disposed of. Copy of the award be supplied to the parties, free of costs, as per rules. File be consigned to the record room.
