Both the parties are represented by   ld. counsels. Ld. counsel for  opp. parties   filed   one petition   no- 569  dtd. 24/6/2015   prayed   for   time for   filing W.S.

Meanwhile   petitioner filed one   petition no- 570 dtd. 24/6/2015   prayed   for   withdrawal  of the case. Petitioner Sri  Debajit Sarma  is personally   present   and he is   identified   by ld.  counsel Pankaj Bora. Heard both sides ld. counsels   regarding   withdrawal   of the case . Ld.  counsel for   opp. party   expressed   his  no  objection  in respect of   withdrawal   of the  present   case. We have  gone  through  the  petition  and   submission. The   withdrwal  petition  will be  marked as “X”   which will   part of  the case   and   which is   verified   by   ld. counsel.

In view   of above    consideration,  the   petitioner Sri  Debajit Sarma   is allowed   to withdraw   the case  with   a liberty   to file  a fresh   case.

Accordingly   the  instant case is   disposed  on withdrawal.
