Respondents No.1 to 3 ex-parte (However, as on today, Sh. JS Rana, Advocate, appeared on behalf of respondent No.3).
Sh. JS Rana, Advocate for the respondent No.3 suffered statement on behalf of respondent No.3, stating, that respondent is ready to replace the AC, subject matter of invoice Ex.C3 with new one, within the period of 30 days from today, subject to return of the defective AC by the complainant to the respondent No.2 within the period of one week from today. He further, submitted, so far cost of litigation is concerned; respondent No.3 may be burdened with minimum cost of litigation.
The suffering of statement by counsel for the respondent No.3, under taking the repair of the AC, with the subject matter of invoice Ex.C3 with new one, prima facie, makes the version of the complainant plausible. The counsel for the complainant is ready to settle the matter. Their statement to this effect has been recorded.
In view of the statement of the counsel for the respondent No.3 and the complainant, without making any adverse comment on the act and conduct of the respondents, matter being amicably settled. This complaint is accepted against the respondent No.3, holding, it liable to replace the AC, subject matter of invoice Ex.C3 with new one of same norms and same costs without any extra charge from the complainant, within the period of one month from today, subject to return of the defective AC of invoice Ex.C3, by the complainant to the respondent No.2 within the period of one week from today. Taking into account, totality of the facts, cost of the litigation is assessed in the sum of Rs.3,000/-, which shall be paid by the respondent No.3 to the complainant, within the period of one month of the date of order. Complaint qua respondents No.1 & 2 is dismissed. File be consigned to the records.
